Where Is Online Casino Legal in the US?

Only a handful of US states license real-money online casino games. Learn which, why so few, how sweepstakes sites differ and how to check your state.

Online casino gambling in the United States is far more restricted than sports betting. Only a handful of states license real-money online slots, table games and live dealer games, and each does it under its own law. This guide explains where regulated online casino exists, how to check your state and why sweepstakes sites are a different thing. It also compares the position in the UK, Ireland, Canada and Australia for international readers.

Laws and launch dates change. This article describes the structure and the main states, and it tells you where to confirm the current status.

What “online casino” means here

Online casino means real-money versions of casino games on a website or app: slots, blackjack, roulette, baccarat and live dealer tables. It is a separate legal category from sports betting. A state can allow one and ban the other, and many states that allow sports betting have no online casino. For how these games work, see how casino games work.

The states with regulated online casino

Regulated online casino is live in only a handful of states. The usual list is:

  • New Jersey
  • Pennsylvania
  • Michigan
  • West Virginia
  • Connecticut
  • Delaware
  • Rhode Island

Nevada is a special case. It allows online poker but has not legalised online slots or table games. Maine has authorised online casino, but its Gambling Control Unit is still working through internet gaming rulemaking, with comments on the latest proposal due by 30 October 2026. Treat Maine as authorised, not as confirmed live, until its regulator announces a launch. New states may be added, and bills in other states have stalled in recent years, so treat any list as a snapshot.

Why so few states, and how regulated play works

There is no federal licence for online casinos, so every state must pass its own law. Commonly cited reasons for hesitation include concern about addiction and underage access, protection of existing casinos, racetracks, tribes and state lotteries, and arguments over tax rates. Some states license many brands, while others allow one or a few operators. The structure also differs: in some states an online brand must partner with an existing land-based casino.

Licensed sites must check your age and identity and usually confirm by location that you are physically inside the state when you play. Minimum ages are set by each state and can differ by product, so read the age rule for your state’s online casino instead of assuming the figure for sports betting or tribal casinos. If you cross a state line, access normally stops.

Regulated sites must offer tools such as deposit limits and time-outs, and each state runs its own self-exclusion arrangement. Look at self-exclusion explained for how these work in general. A licence from one US state does not give an operator the right to serve another.

Sweepstakes sites are different

Sweepstakes casinos use virtual coins and describe their games as promotions with no purchase necessary. They argue that this puts them outside gambling law. They are not licensed as casinos, so the protections of a regulated market, including testing requirements and complaint routes, may not apply. Several states have passed laws or sent warning letters to restrict them, and the position is shifting. See sweepstakes and social casinos explained for more detail.

Offshore casinos that accept US players are a further step removed. They hold no US state licence. Read why offshore-licensed gambling sites are risky before trusting one.

What regulated does not mean

A licence does not change the maths. Every casino game has a house edge, and over time the house keeps a share of the money wagered.

Here is a simple illustration, with invented figures chosen to show the idea, not to describe any real game. Suppose a slot returns 96% over the long run, which means the house edge is 4%. Suppose a player bets $1 per spin and plays 10 spins a minute. That is 600 spins and $600 in total wagered per hour. At a 4% edge, the long-run expected loss is $600 x 0.04 = $24 per hour. Actual results swing widely around that average, so a player can win or lose far more in a session, but the average cost is real and it adds up.

A free tool such as the spend tracker can show how quickly this accumulates against your own budget.

How to check your state

  • Find the regulator: It might be a gaming commission, control board or lottery body.
  • Check the licensed list: Regulators usually publish approved operators. A brand that is not listed in your state is not licensed there.
  • Confirm the product: A state that licenses sports betting may not license casino games.
  • Check the terms: Read the age rules, limits and complaint process. Bonus terms matter too, and how bonuses actually work explains why.

If you are comparing with sports betting, the state guide to sports betting covers that side.

Rules by country

  • United States: State by state. Online casino is live in only a handful of states, with the minimum age set by each state and product. Winnings are federally taxable income.
  • United Kingdom: Licensed online casino is available in Great Britain through operators licensed by the UK Gambling Commission. The minimum age is 18.
  • Ireland: Online licensing is being rolled out by the Gambling Regulatory Authority of Ireland, with betting first. Do not assume Irish-licensed online casinos are yet available.
  • Canada: Provinces regulate. Ontario has a regulated private online market, and other provinces run provincial sites or are developing their own models. The age is 19 in most provinces and 18 in Alberta, Manitoba and Quebec.
  • Australia: Real-money online casino games, including pokies, are prohibited for people in Australia. Licensed operators may offer online wagering on sports and racing only.

The bottom line

Regulated online casino is legal in only a handful of US states, and a licence from one state does not carry over to another. Check your state regulator’s licensed list, be wary of sweepstakes and offshore sites, and remember that the house edge applies to every spin and hand. Set a budget before you start and stop when it is reached.
