How US Sports Betting Legality Works State by State

How US sports betting became a state-by-state matter, how retail, online and tribal models differ, and how to check a sportsbook is legal where you live.

Sports betting in the United States is not governed by one national rulebook. Each state decides whether to allow it, who may run it and how it is taxed. This guide explains how that patchwork came about and how to check your own state. Readers in the UK, Ireland, Canada and Australia will find a short comparison near the end.

The details change often, so this article does not print a table of states or a count. A table would be out of date quickly, and it would need a dated regulator source for every row. Instead it explains the structure and shows how to find your own state’s current status on its regulator’s site.

Why the US is a patchwork

For decades a 1992 federal law, usually called PASPA, stopped most states from authorising sports betting. In May 2018 the US Supreme Court decided Murphy v. NCAA and struck that law down. The Court reasoned that Congress could not order states to keep their own laws against sports betting. The decision did not legalise betting anywhere by itself. It handed the choice back to each state.

Since then, states have taken different routes. Some moved quickly, others are still debating, and some have no legal market. There is still no federal licence that lets an operator serve the whole country.

The main models

States tend to fall into a few broad groups, and a state can move from one group to another.

  • Retail only: Betting is allowed in person at casinos, racetracks or similar venues, but not through phone apps.
  • Retail and online: Licensed operators can take bets in person and through approved websites and apps.
  • Online with a limited field: Some states license only a small number of operators, or run betting through the state lottery, so there are fewer brands to choose from.
  • No legal market: Sports betting is not authorised, and operators that accept bets from residents are not state-licensed.

Tribal compacts

Under a federal law called the Indian Gaming Regulatory Act, a tribe and a state can sign an agreement, known as a compact, that sets the rules for certain casino-style gaming on tribal land. In some states, sports betting follows this route. The tribe, rather than a list of independent companies, holds the right to offer it, sometimes partnering with other businesses.

Mobile betting raises a hard question, because a phone bet is placed where the person is standing, not where the server is. Some compacts deal with this by treating the bet as taking place on tribal land. Court challenges over such arrangements have occurred, so the legal detail varies from state to state.

Retail versus online

Retail betting means a person walks up to a counter or kiosk. Online betting runs through licensed apps, which usually use location checks to confirm you are physically inside the state when you place a bet. If you travel across a state line, an app that works at home may stop working, or you may need to use a different one.

Bet types also vary. Some states limit certain markets, such as bets on college teams or players. The regulator’s website shows what is currently allowed.

How to check a sportsbook in your state

Use a short routine before you deposit anywhere.

  • Find the regulator: Search for your state’s gaming commission, lottery or control board.
  • Check the status: Look for whether betting is authorised, whether retail venues are open, whether online betting is live, the minimum age, and the date of the regulator’s page. If a brand is not on your state’s licensed list, treat it as unlicensed.
  • Check your age: Most states set 21 as the minimum age, and a few allow 18. Betting under the minimum age is not allowed.
  • Read the account rules: Look at deposit limits, time-outs and self-exclusion options. Self-exclusion is state by state, so see self-exclusion explained.
  • Avoid offshore sites: A site that is licensed somewhere else is not licensed for you. See why offshore-licensed sites are risky.

Legal does not mean fair value

A legal sportsbook still builds in a margin. Take, for illustration, standard American odds of -110 on both sides of a point spread. A bettor must stake $110 to win $100 profit. The implied probability of each side is 110 divided by 210, which is 52.38%. The two sides add up to 104.76%. That extra 4.76 points is the bookmaker’s built-in margin. Against the total, it equals a hold of about 4.5% if the book balances its action.

In plain terms, you need to win more than about 52.4% of your -110 bets just to break even. Most bettors do not do so over time, so a budget matters more than any licence. You can learn how the lines work in US sports betting spreads, moneylines and totals, and the general mechanics in how sports betting works. Winnings are also taxable income at federal level, covered in gambling winnings tax.

Rules by country

  • United States: Regulation is state by state. Sports betting is legal in most states, but not all. Some allow retail only, some allow online, and a number of states have nothing live. Ages are mostly 21, with some at 18.
  • United Kingdom: Betting is licensed nationally by the UK Gambling Commission for Great Britain. The minimum age is 18 for nearly all products.
  • Ireland: Betting is being brought under a new licensing system run by the Gambling Regulatory Authority of Ireland, with betting first. Self-exclusion is currently per operator.
  • Canada: Provinces regulate gambling. Single-event sports betting became lawful for provinces to offer after a 2021 change to federal law. Ages are 19 in most provinces and 18 in Alberta, Manitoba and Quebec.
  • Australia: Licensed wagering operators can offer sports and racing betting. Online casino games are prohibited for people in Australia. The national BetStop register covers licensed online and phone wagering.

The bottom line

US sports betting is legal or not depending on the state, and the model, the age limit and the available operators differ from place to place. Check your state regulator’s licensed list, avoid offshore sites, remember that every line contains a margin, and set a limit first. Use the spend tracker to keep an honest record of what you spend.
