Sweepstakes and Social Casinos Explained

How sweepstakes casinos claim to be legal, how they differ from licensed casinos, why US states are acting against them, and what risks players face.

Sweepstakes casinos look like online casinos. They offer slots, table games and jackpots, yet their operators say they are not gambling sites. This guide explains how the model works, why its legality is contested, and how it differs from a licensed casino. It covers the UK, US, Ireland, Canada and Australia, though the model is mainly a US phenomenon.

A separate product, the social casino, is also covered. These are free-to-play casino-style games that use virtual coins.

How the sweepstakes model works

Most sweepstakes sites use two kinds of virtual currency. The first, often called gold coins, is for play only and has no cash value. The second, often called sweeps coins, can be redeemed for prizes, including cash or gift cards, once certain conditions are met.

Players typically buy a coin package. The sweeps coins arrive as a free bonus with the purchase. The site also offers a free route to get sweeps coins, such as a postal request or daily login. The operator’s legal argument is that nobody has to pay to enter, so the games are a promotional sweepstakes and not a wager. Whether that argument holds is exactly what is being contested.

Why legality is disputed

In many US states, gambling is defined by three elements: a prize, chance and consideration, meaning something of value paid to play. Sweepstakes operators say that the free entry route removes consideration. Regulators and attorneys general often reply that the real design is a casino: players buy coins, play slot-style games and chase redeemable prizes, so the free route is cosmetic.

The picture changes quickly. New York’s law S5935-A, signed on 5 December 2025, defines online sweepstakes games by their dual-currency design and bars licensed gaming businesses, payment processors and platform providers from supporting them, with fines of $10,000 to $100,000 per violation. Other states have passed or are considering similar laws, and their dates and scope vary, so check your state’s gaming regulator or legislature before assuming a site is allowed where you live.

How it differs from a licensed casino

A licensed casino holds a licence from a regulator that sets rules on game testing, player protection and complaints. A sweepstakes site generally does not hold a gambling licence, because it says it is not gambling. That has practical effects:

  • Protections: Rules for deposit limits, self-exclusion and independent dispute routes may not apply, or may be voluntary.
  • Disputes: A state gaming regulator that handles complaints about its licensees may not take your complaint. See how gambling complaints and disputes work.
  • Payouts: Redemption rules can include identity checks, minimum balances and processing times set by the site.
  • Availability: Access can be switched off in a state when a law changes.

Worked example: why coin packages cost more than they look

The numbers below are for illustration only, not any real site’s terms. Say a $20 package includes 20,000 gold coins and 20 sweeps coins. Each sweeps coin is worth $1 on redemption, the minimum redemption is 50 sweeps coins, and sweeps coins must be played through once before redeeming.

If you buy this package once, you have 20 sweeps coins and cannot redeem anything until you reach 50. To get there, you play, or you buy more. If the game has a 4% house edge, playing through 20 sweeps coins once has an expected cost of 80 cents. Each further package costs real money. The “free” bonus is attached to a purchase, and repeated play is expected to lose, as with any casino game.

Social casinos with no prizes

Social casino apps let you play slots and cards with virtual chips that cannot be redeemed. In law they are often not treated as gambling because there is no cash prize. Even so, in-app purchases cost real money, they can be bought repeatedly, and the games use the same reward features as slots. Parents should be aware that these apps can expose children to casino-style play. See parents, children and gambling.

Rules by country

  • United Kingdom (Great Britain): Real-money gambling for people in Great Britain needs a Gambling Commission licence. A site offering casino-style games with redeemable prizes should be treated as unlicensed until you find it on the Commission’s public register. See how to spot unlicensed gambling sites.
  • United States: Regulation is state by state. Sweepstakes casinos sit in a grey area, and a growing number of states are acting against them. Online casino itself is legal and licensed in only a handful of states. See where online casino is legal in the US.
  • Ireland: Online casino licensing by the Gambling Regulatory Authority of Ireland has not yet opened, so any site offering prizes for casino-style play is not licensed in Ireland for that activity.
  • Canada: Provinces regulate gambling. In Ontario, the AGCO says it cannot resolve disputes with unregulated operators, and players there are advised to use regulated sites. See Ontario iGaming explained.
  • Australia: Online casino games and online pokies are prohibited for people in Australia. Treat a prize-for-play casino site aimed at Australians as illegal.

Practical checks and safer habits

  • Read the terms for redemption rules, minimums and what happens if your state changes its law.
  • Set a purchase limit before you start and track spending with the spend tracker. Coin purchases are real money, and many people lose track of them.
  • Know your tax position. In the US, prizes may count as taxable income, and you should check IRS guidance.
  • Do not chase losses. If you want to stop, read self-exclusion explained. Sweepstakes sites are typically outside licensed schemes, so use blocking tools as well.

The bottom line

Sweepstakes casinos use a free-entry route and two currencies to claim they are not gambling, but regulators in a growing number of US states disagree, and the sites usually fall outside licensed protections. Social casinos with no prizes are a different product, but their purchases still cost real money. Whatever the label, treat casino-style play as entertainment with a built-in cost, set a limit before starting and verify a site’s licence.
