How Gambling Complaints and Disputes Work

The usual path from operator complaint to independent dispute body or regulator in the UK, Ontario, Australia, US states and Ireland, plus how to prepare.

Most gambling problems with a licensed operator, such as a disputed bet, a delayed withdrawal or a closed account, can be raised through a formal complaint. The route is similar in many places: complain to the operator first, then escalate. What changes is who sits at the next step. This guide covers the UK, US, Ireland, Canada and Australia.

This is general information, not legal advice, and deadlines can change. Read the current page of the regulator that licenses your operator.

Step one: the operator’s own complaint process

Regulators almost everywhere expect you to use the operator’s complaints procedure first. Check the terms linked to your account or the bet, then find the complaints policy, usually in the site footer or help section. Send the complaint in writing so there is a record, and ask for a complaint or reference number.

Include dates, amounts, bet or game identifiers and screenshots, and say plainly what outcome you want.

Step two: independent dispute resolution or the regulator

What happens next depends on the country. In some places there is an independent dispute body that can look at your case. In others the regulator checks whether rules were broken but does not award you money. Knowing the difference stops disappointment.

Rules by country

  • United Kingdom: The Gambling Commission says that in Great Britain the business has 8 weeks from receiving your complaint to resolve it. If you are not satisfied, you may be able to escalate to an Alternative Dispute Resolution (ADR) provider, but only after going through the business’s own process. Licensed operators must use an approved provider, and your operator’s terms say which one. IBAS and eCOGRA are two commonly used ones. The Commission itself does not handle individual complaints through its feedback form.
  • United States: There is no single route. Regulation is state by state, and for licensed operators the state gaming regulator is the escalation point. In New Jersey, the Division of Gaming Enforcement says you must file with the operator and get a response before using its internet gaming dispute form. In Pennsylvania, the Gaming Control Board says a patron dispute must be filed within 30 calendar days of the incident, so do not let that clock run out while you pursue the operator’s internal complaint. Check your own state’s deadlines.
  • Ireland: The Gambling Regulatory Authority of Ireland says it cannot resolve individual disputes between players and operators, so raise the issue with the operator first. Under the Gambling Regulation Act 2024, a person can complain to the authority that a licensee has breached its obligations, but the system is new and still being phased in. Check the authority’s website for the current process.
  • Canada: Provinces regulate. In Ontario, the AGCO says to use the operator’s formal process first, and notes that a site’s decision can take up to 90 days. That is an estimate of the operator’s turnaround, not a fixed waiting period, so wait until the operator has had reasonable time under its own service standards. The AGCO’s internet gaming complaints page then describes its review in stages: an initial review of about 2 business days, a compliance review of up to 5 weeks, and for complex cases 3 to 6 months or more. Its role is to enforce rules. It cannot get your money back, and a penalty on the operator does not resolve your individual dispute. It cannot help with unregulated operators.
  • Australia: Online wagering operators are licensed by states and territories. Many corporate bookmakers are licensed in the Northern Territory, whose Racing and Wagering Commission takes complaints after you have tried the operator. It asks for the operator’s dispute reference number, a record of contact and documents, and expects the complaint within 60 days of becoming aware of the issue, and no later than two years after it occurred. Late complaints need reasons and are still subject to the two-year maximum. It cannot consider matters such as compensation claims or complaints about account closure or restrictions. If your operator is licensed elsewhere, use the regulator for that state or territory.

Worked example: a withdrawal complaint timeline

This is for illustration, with invented figures. Suppose a UK player requests a withdrawal on day 1 and it stays pending. On day 3 they send a written complaint and receive a reference number. The operator has 8 weeks, or 56 days, from receipt, so until about day 59. The operator replies on day 40 with a final response the player disagrees with. They can now take the dispute to the operator’s named ADR provider, with the reference number, the operator’s final response and screenshots.

In Ontario the operator’s decision can take up to 90 days, but that is an estimate, not a mandatory wait, and any filing deadlines still run. A dated log saves time. See why gambling withdrawals get delayed, because many delays are caused by identity checks that you can resolve by supplying documents.

What regulators and dispute bodies usually cannot do

  • Award compensation: Many regulators enforce rules rather than award money to individuals.
  • Reopen outcomes you dislike: A losing bet that was settled correctly under the rules is not a valid complaint, even if the loss hurts.
  • Help with unlicensed sites: If the operator is not licensed locally, there may be no route at all. See why offshore-licensed sites are risky.

Preparing a stronger complaint

  • Complain early, in writing, and keep the tone factual.
  • Quote the specific term or rule you think was broken.
  • Attach evidence: screenshots, emails, transaction records and bet slips.
  • Ask for the complaint reference number and the final response in writing.
  • Do not send further money to release a withdrawal. That is a common scam.

If a dispute is large, consider independent legal advice. If you are spending more than planned or feel pressured to keep playing while you wait, use a limit or break and track spending with the spend tracker.

The bottom line

The sequence is nearly always the same: complain to the operator, keep a record, then take the matter to an independent dispute body or the regulator for your licence. Timescales and powers differ, and regulators generally enforce rules without paying you compensation. Use the regulator’s own page for your location, act quickly, and remember that gambling losses on valid bets are not a ground for complaint.
